Nairobi Governor Mike Mbuvi Sonko has moved to court seeking to stop treasury from releasing Nairobi county government money to Nairobi Metropolitan Services saying NMS has no legal back up to receive county cash.
The case has been certified as an urgent by the court.
Sonko’s petition was filed by his lawyers led by Kinyanjui Rosemary Kimani.
According to Sonko, Deed of Transfer indicates that the funding of all transferred functions should be done by the county government .
In a petition the county government through Chief Finance Officer Halkano Waqo, Sonko also wants the court to stop NMS from micromanaging its budgetary allocations.
Last week Sonko asked senate to summon NMS boss Mohammed Badi over county budgets and development projects saying NMS boss has been ignoring him with an aim of outshining him.
‘‘I cannot launch any project , I did 100 roads, I need those who voted for me to see what I have done, instead all this has been blocked by NMS.’’ Sonko told Senate.
Sonko maintained that Badi has been blackmailing him with impeachment threats and even blocking him from attending any NMS functions.
