Court of Appeal upholds Starehe MP Jaguar’s election

The court of Appeal has upheld the election of Charles Njagua alias Jaguar as Starehe MP.

Steve Mbogo’s appeal was dismissed and the costs reduced from Ksh.10 million to Ksh.4 Million.

The judge ruled that the High Court did not err in its ruling that Jaguar’s election was in accordance with the constitution.

“The High Court Judge misapprehended the law on the issue of failure to demand for a recount at the polling station,” Justice Agnes Murgor said.

According to her, there was no basis to say that failure to seal the ballot boxes and the alleged excess 111 votes were major irregularities to warrant the nullification of the said election.
