A case in which the Attorney General Githu Mwigai has sued 14 county assemblies for approving the people’s assembly has been referred to chief justice for hearing.
The chief justice is to initiate a bench that will be involved the hearing.
Justice Chacha Mwita ruled that the matter raised separate and independent points of law and the constitution but required higher jurisdiction.
Attorney General has sued county assemblies of Kilifi, Homabay, Mombasa, Kwale, Kisumu, Migori, Machakos, Vhiga, Bungoma, Busia, Kitui, Makueni, Siaya and Kakamega for passing motions establishing the assemblies.
He says the 14 county assemblies are violating the constitution arguing that they use public resources in illegal activities.
According to AG the people’s assembly is neither established within the framework of the County government Act or any other legislation.
